RETURN AND REFUND POLICY

1. PURPOSE AND SCOPE
This Return and Refund Policy (“Policy”) governs refund, return, and cancellation rights for transactions conducted through ArtJobMarket.com (“Platform”).
The Platform operates solely as a neutral marketplace. All products and services are offered by independent third-party Sellers. Refund eligibility is primarily determined by the Seller’s stated refund terms, subject to applicable law.
2. GENERAL PRINCIPLE: DIGITAL AND INTANGIBLE GOODS
Most products offered on the Platform consist of digital content and AI-related intellectual products, including but not limited to prompts, datasets, software code, documentation, training materials, and consulting services.
Unless otherwise required by applicable law or expressly stated by the Seller:
- All sales are final
- No returns or refunds are available once access, download, delivery, or performance has commenced
3. SELLER-DEFINED REFUND TERMS
3.1 Seller Autonomy
Each Seller may define their own refund or cancellation policy, which must be clearly disclosed in the applicable listing.
3.2 Buyer Responsibility
Buyers are responsible for reviewing the Seller’s refund terms prior to purchase.
3.3 No Platform Guarantee
The Platform does not guarantee refunds and is not a party to Seller refund commitments.
4. STATUTORY WITHDRAWAL RIGHTS (EU / EEA)
4.1 Digital Content Exception
Under EU consumer law, Buyers acknowledge and expressly agree that:
- the 14-day right of withdrawal does not apply once digital content delivery has begun, and
- by completing a purchase, the Buyer expressly consents to immediate delivery and acknowledges the loss of the right of withdrawal, where applicable.
4.2 Services and Consulting
For consulting or training services not yet performed, statutory cancellation rights may apply as required by law, subject to Seller terms.
5. NON-REFUNDABLE CIRCUMSTANCES
Refunds will not be issued for:
- dissatisfaction with AI outputs or performance
- incompatibility with Buyer systems or workflows
- changes in Buyer needs or expectations
- lack of results from AI usage
- alleged inaccuracies inherent to probabilistic AI systems
- failure to read product descriptions or license terms
6. DEFECTIVE OR MISREPRESENTED PRODUCTS
If a product is:
- materially defective,
- substantially different from its description, or
- inaccessible due to technical failure attributable to the Seller,
the Buyer may contact the Seller directly to request remediation or refund, subject to Seller policy and applicable law.
The Platform may, at its discretion, assist in communication but assumes no liability.
7. PLATFORM-INITIATED REFUNDS
The Platform reserves the right, but not the obligation, to:
- reverse transactions in cases of fraud, duplicate charges, or payment errors
- comply with legal or regulatory requirements
- enforce these Terms or Platform policies
8. CHARGEBACKS AND PAYMENT DISPUTES
Buyers are encouraged to contact the Seller and the Platform before initiating a chargeback.
Unjustified chargebacks may result in:
- account suspension or termination
- restriction of future purchases
9. SELLER OBLIGATIONS REGARDING REFUNDS
Sellers are solely responsible for:
- honoring their stated refund policies
- complying with consumer protection laws
- processing approved refunds promptly
The Platform may deduct refunded amounts and associated fees from Seller payouts.
10. TAXES AND FEES
Refunds, if issued, may:
- exclude Platform service fees where permitted by law
- exclude non-refundable payment processing fees
- be adjusted for applicable taxes
11. LIMITATION OF PLATFORM LIABILITY
To the maximum extent permitted by law, the Platform shall not be liable for:
- Seller refusal to issue refunds
- Buyer dissatisfaction with AI outputs
- consequential or indirect losses related to refunds or returns
12. POLICY CHANGES
This Policy may be updated at any time. Continued use of the Platform constitutes acceptance of the revised Policy.
